Montenegro starts work on the spatial plan for its coastal area

The Government of Montenegro adopted the decision to draw up the Spatial Plan of the Special Purpose Area for the Coastal Area of Montenegro. The decision was published in Službeni list Crne Gore, broj 126/2026 on 26 August 2026 and, according to the gazette register, entered into force on 3 September 2026. The register records it as adopted on the basis of the Spatial Planning Act (Zakon o uređenju prostora).

What it means for you

A special-purpose spatial plan is the planning document for the area it covers, and preparation of the one for Montenegro's coastal area formally began when the decision took effect on 3 September 2026.

Montenegro amended its act on legalising unpermitted buildings

The Parliament of Montenegro amended the Act on the Legalisation of Unpermitted Buildings (Zakon o legalizaciji bespravnih objekata). The amending act was published in Službeni list Crne Gore, broj 117/2026 on 7 August 2026 and, according to the gazette register, entered into force on 15 August 2026. The register records it as amending and supplementing the Act on the Legalisation of Unpermitted Buildings.

What it means for you

Whether a structure standing on a plot has been legalised decides what its owner or a buyer can do with it, and the statute governing that procedure has applied in its amended form since 15 August 2026.

New Montenegrin rulebook sets zones where planning and building are not allowed

A rulebook on the width of protection zones and the types of radio corridors in whose zone the planning and construction of buildings is not allowed was published in Službeni list Crne Gore, broj 116/2026 on 5 August 2026. According to the gazette register it was issued by ministries under the Electronic Communications Act, entered into force on 13 August 2026 and repeals the earlier rulebook on the same subject.

What it means for you

A plot can lie inside a protection zone or a radio corridor in which planning and construction are not allowed, and the rulebook defining the width and type of those zones was replaced on 13 August 2026.

Montenegro's Construction of Buildings Act amended, in force the day it was published

The Parliament of Montenegro amended the Construction of Buildings Act (Zakon o izgradnji objekata). The amending act was published in Službeni list Crne Gore, broj 114/2026 on 3 August 2026 and, according to the gazette register, entered into force on 3 August 2026 — the same date. The same issue also carries amendments to the Spatial Planning Act (Zakon o uređenju prostora) and to the act on brokerage in the sale and lease of real estate.

What it means for you

Anyone planning or already running a building project in Montenegro has been working under the amended Construction of Buildings Act since 3 August 2026: the register gives the same date for publication and for entry into force, so the amended text applied immediately.
