Most sending states regulate the agency. The Philippines regulates you.
That is the distinguishing feature of this corridor, and it is the one employers consistently discover too late. A Montenegrin company cannot simply select a licensed Philippine agency and let it work. The company itself — the foreign principal — has to be accredited by the Philippine authorities, through that agency, before a Filipino worker can be deployed to it.
Filipino nationals were recorded at 138 workers in Montenegro in 2025, within a foreign workforce of 40,567 from 107 countries. Small in absolute terms, but the corridor is well-established globally and the process is correspondingly formal.
Legal position stated as at 3 September 2026.
The DMW, and what it replaced
Republic Act No. 11641, signed on 30 December 2021 and taking effect in February 2022, created the Department of Migrant Workers (DMW), which absorbed the functions of the former Philippine Overseas Employment Administration (POEA) and several related offices.
If you are working from guidance that refers to the POEA, it is not necessarily wrong on substance — much of the POEA's regulatory output continues to apply — but the institution you will actually deal with is the DMW and its overseas arm, the Migrant Workers Office (MWO).
Accreditation is of the foreign employer
Under the framework, accreditation means the grant of authority by the Department to a foreign principal or employer to recruit and hire Filipino workers through a licensed recruitment agency.
Read the definition carefully, because two things follow that surprise employers:
- The authority is granted to you, not merely to the agency. Your company is the subject of a Philippine administrative act.
- The authority exists only in conjunction with a licensed agency. There is no accredited-and-independent route in which you deal with candidates directly.
Foreign employers are required to undergo verification and accreditation through the Migrant Workers Office and the DMW. In practice that means a Philippine government office assesses your company before a worker is placed with it.
What the file on you contains
The documentary requirements set out under the applicable POEA memorandum circular — Memorandum Circular No. 16-2022, now administered within the DMW — are submitted to the MWO for verification. The core items are:
- a notarised Recruitment Agreement or Special Power of Attorney, setting out the responsibilities of the parties for the orderly deployment, employment and return of the Filipino worker;
- a photocopy of a valid identification document of the signatory to that agreement;
- the commercial registration and business licence of the principal;
- a notarised undertaking by the principal and the agency to monitor the employment of the overseas Filipino workers concerned.
Three of those four are documents about your company rather than about the worker. The last is a continuing obligation: you undertake to monitor, not merely to hire.
⚠️ Note what the Recruitment Agreement or SPA has to cover — deployment, employment and return. The return leg is part of the arrangement from the outset. An employer planning only to the start date has not read the document it is signing.
Documents: apostille has applied since 2019
The Philippines acceded to the 1961 Hague Apostille Convention on 12 September 2018, and it entered into force for the Philippines on 14 May 2019. Montenegro is a party by succession, in force 3 June 2006, so the Convention operates between the two.
An apostille is therefore sufficient for Philippine public documents; there is no consular legalisation chain. Certified translation into Montenegrin remains a separate step, and the apostille certifies the origin of a document rather than the truth of its contents.
The document chain is consequently not where this corridor's time goes. The accreditation of your company is.
There is no social security agreement between Montenegro and the Philippines, so contributions are paid where the work is performed with no aggregation of insurance periods.
The Montenegrin half, briefly
The receiving side is ordinary. In short: Article 66(1) of the Zakon o strancima allows work only on a residence-and-work permit or a work registration certificate — an entry route is never a work route — and only the permit bases under Article 40(3) consume the annual quota, set at 28,988 for 2026.
The filing mechanics, the quota, the eight no-permit situations under Article 67(1) and the Article 85 certificate list are in our guide to foreign worker employment in Montenegro and the quota page.
Sequencing, which runs opposite to most corridors
- Identify a licensed Philippine agency first. Accreditation runs through one; without it there is nothing to file.
- Assemble your own corporate documents — registration, business licence, signatory identification. These are about the company, and gathering them is the step employers forget to start early.
- Agree and notarise the Recruitment Agreement or SPA, covering deployment, employment and return, plus the monitoring undertaking.
- Accreditation through the MWO and DMW.
- Then the Montenegrin permit, and the contract-and-insurance registration within 24 hours of issuance, counted from the permit date rather than the arrival date.
Because step 4 is a foreign administrative process about your company, it is the item least under your control, and it should be started before, not after, you commit to a mobilisation date.
What this page does not tell you
It does not state current DMW processing times or fees, which are administrative and change. It does not name or vouch for any agency. It does not advise on Philippine law — for accreditation requirements as they apply to your company, take Philippine advice or approach the Migrant Workers Office competent for your region.
RoNa Legal is a registered employment intermediary under activity code 78.10 and a legal adviser. We do not supply, lease or second workers, and we are not an employer of record. We build the Montenegrin file and coordinate with licensed agencies where the structure requires one.
Send us the engagement structure before you approach an agency — in this corridor the accreditation file is about your company, and it is far cheaper to assemble correctly the first time. Our services are set out on the services page and a file can be opened through the contact page.
