Hiring Pakistani Workers in Montenegro: A Pakistani Official Will Read Your Wage Offer

Pakistan requires your demand letter to be attested abroad, and a Protector of Emigrants judges whether your wage offer is reasonable.

Employer guide to work permits in Montenegro

There is a step in this corridor that no amount of Montenegrin preparation can substitute for, and it is unusually intrusive from an employer's point of view: before recruitment may even be processed, a Pakistani public officer examines the terms you are offering and forms a view on whether they are reasonable.

That is not a formality. It is a discretionary gate, and it is applied to your document.

Pakistan does not appear separately in the published nationality breakdown of Montenegro's 40,567 foreign workers from 107 countries in 2025, so there is little local precedent to lean on.

Legal position stated as at 3 September 2026.

The framework: the 1979 Ordinance and the Bureau

Outbound employment from Pakistan is regulated by the Bureau of Emigration and Overseas Employment (BEOE), operating under the Emigration Ordinance, 1979 (Ordinance XVIII of 1979) and the Emigration Rules, 1979, which have been updated as recently as 2023.

The scheme works through licensed intermediaries — Overseas Employment Promoters (OEPs) — and through the Protector of Emigrants, the officer who authorises the processing of a foreign employer's manpower demand.

The demand letter, and where it has to be attested

The document that starts everything is the demand letter: your statement of what you need. Under the Rules it must specify the categories of workers required, the number of jobs against each category, the terms and conditions of service, and the qualification or experience required for each post.

The demand letter must then be attested, and the Rules give three alternative routes. It may be attested by:

  • the Ministry of Foreign Affairs of the country of the employer;
  • the Embassy of Pakistan in that country; or
  • the embassy of the employer's country in Pakistan.

For a Montenegrin employer this is where the corridor becomes concrete rather than theoretical. The attestation has to come from Montenegro's own foreign ministry, from a Pakistani mission accredited for Montenegro, or from a Montenegrin mission in Pakistan. Which of the three is practically available to you is a question to settle before you build a timetable, not after — because the answer determines whether the step takes a fortnight or considerably longer.

The Protector of Emigrants, and the reasonableness test

Permission to process the demand comes from the Protector of Emigrants, who scrutinises it and grants permission only on being satisfied of three things:

  1. that the Overseas Employment Promoter holds a power of attorney from the employer;
  2. that there is a letter of manpower demand, duly attested by one of the three routes above; and
  3. that the wages and other terms and conditions of service offered are reasonable.

The third is the one to plan around. Your offer is assessed by a foreign official against a standard you do not control and cannot see in advance. An offer pitched to the bottom of the Montenegrin market may clear Montenegrin law comfortably and still fail here.

The practical response is not to guess. It is to have the OEP test the terms informally before the formal demand is lodged, and to expect that the wage figure, not the paperwork, is the item most likely to require revision.

Documents: apostille has applied since March 2023

Pakistan acceded to the 1961 Hague Apostille Convention on 8 July 2022, and it entered into force for Pakistan on 9 March 2023. Montenegro is a party by succession, in force 3 June 2006, so the Convention operates between the two.

An apostille is therefore sufficient for Pakistani public documents; there is no consular legalisation chain. Certified translation into Montenegrin remains a separate step, and the apostille certifies the origin of the document rather than the truth of its contents. Guidance written before 2023 will tell you otherwise and is out of date.

Note the contrast within the region: Sri Lanka is not a party, so a document strategy carried across from a Sri Lankan file will be wrong here — and in that direction the error is expensive rather than merely wasteful.

There is no social security agreement between Montenegro and Pakistan; contributions are paid where the work is performed, with no aggregation of insurance periods.

The Montenegrin half, briefly

The receiving side is ordinary. In short: Article 66(1) of the Zakon o strancima allows work only on a residence-and-work permit or a work registration certificate — an entry route is never a work route — and only the permit bases under Article 40(3) consume the annual quota, set at 28,988 for 2026.

The filing mechanics, the quota, the eight no-permit situations under Article 67(1) and the Article 85 certificate list are in our guide to foreign worker employment in Montenegro and the quota page.

Sequencing

  1. Settle the attestation route first. It is the item with the widest range of possible durations and it gates everything else.
  2. Fix the wage and terms with the reasonableness test in mind, before the demand is formally lodged.
  3. Power of attorney to the OEP, in the form the Rules require.
  4. Permission to process from the Protector of Emigrants.
  5. The Montenegrin permit, then the contract-and-insurance registration within 24 hours of issuance, counted from the permit date rather than the arrival date.

What this page does not tell you

It does not tell you what wage level will be found reasonable — that is a discretionary assessment and we will not pretend to predict it. It does not name or vouch for any Overseas Employment Promoter. It does not advise on Pakistani law — for the attestation route available to a Montenegrin employer and the current form requirements, take Pakistani advice or approach the BEOE.

RoNa Legal is a registered employment intermediary under activity code 78.10 and a legal adviser. We do not supply, lease or second workers, and we are not an employer of record. We build the Montenegrin file and coordinate with licensed agencies where the structure requires one.

Send us the engagement structure before the demand letter is drafted — in this corridor the demand letter is the document that has to satisfy a foreign officer's discretion, and its contents are worth getting right the first time. Our services are set out on the services page and a file can be opened through the contact page.

Legal basis

Frequently asked questions

What is a demand letter and what must it contain?

It is the foreign employer's statement of manpower requirement. Under the Emigration Rules 1979 it must specify the categories of workers required, the number of jobs against each category, the terms and conditions of service, and the qualification or experience required for each post.

Where does the demand letter have to be attested?

By one of three: the Ministry of Foreign Affairs of the employer's country, the Embassy of Pakistan in that country, or the embassy of the employer's country in Pakistan. For a Montenegrin employer, which of the three is practically available determines the timetable, so settle it first.

Can a Pakistani official really reject our wage offer?

The Protector of Emigrants grants permission to process a demand only on being satisfied that the wages and other terms and conditions offered are reasonable, alongside the power of attorney and the attested demand letter. It is a discretionary assessment applied to your offer, so test the terms informally before lodging the formal demand.

Do Pakistani documents need consular legalisation?

No. Pakistan acceded to the Apostille Convention on 8 July 2022 and it entered into force on 9 March 2023, so an apostille suffices between Pakistan and Montenegro. Certified translation into Montenegrin remains a separate step. Note that Sri Lanka is not a party, so do not carry a Pakistani document strategy across to a Sri Lankan file.

Is there a social security agreement between Montenegro and Pakistan?

No. Contributions are paid where the work is performed and no insurance periods are aggregated between the two systems.

Does a Pakistani worker consume the Montenegrin quota?

If the basis is employment, seasonal employment or posted work under Article 40(3), yes — those run on a permit and draw on the 2026 quota of 28,988. An Article 85 work registration certificate and the eight situations in Article 67(1) do not.

Can you recruit Pakistani workers for us?

No. RoNa Legal is a registered intermediary under code 78.10 and a legal adviser, not a labour supplier, leasing agency or employer of record. We build and run the legal file and coordinate with licensed agencies where one is needed.
