Of all the sending-state regimes in this country set, Nepal's reaches furthest into the employer's own premises. The attestation your file needs is not granted on the papers alone. Where the mission considers it necessary, it is granted after a visit to the employer's office and the workers' accommodation.
Employers who have recruited from lightly regulated corridors tend to plan this one as a paperwork exercise. It is not.
Nepali nationals were recorded at 108 workers in Montenegro in 2025, within a foreign workforce of 40,567 from 107 countries.
Legal position stated as at 3 September 2026.
The framework: the 2007 Act and the Department
Outbound employment from Nepal is governed by the Foreign Employment Act, 2064 (2007) and the Foreign Employment Rules, 2064 (2007), administered through the Department of Foreign Employment (DoFE).
The structure is agency-mediated by design. A foreign employer recruits through a licensed agency registered with the Nepali labour authorities; the agency, on receiving an authenticated vacancy demand, has the relevant documents attested and then applies to the Director General for permission to recruit. Permission comes before recruitment, not after.
The four documents, and where they have to be authenticated
The bundle is specific. Demand letter, power of attorney, the agreement between the two agencies concerned, and the service contract must be authenticated — and the Rules give a chain rather than a single stamp.
First, in the destination country, by the labour department, the ministry of foreign affairs, or the chamber of commerce and industry.
Then, by the Embassy of Nepal. And this is where the requirement becomes unusual: the Nepali mission authenticates on the presentation of approval of the labour authorities in the relevant country, together with attestation by the chamber of commerce or another competent authority — and, if necessary, after a visit to the employer's office and labour camp.
Read the sequence carefully, because it contains a trap for a Montenegrin employer. The Nepali mission expects to see that the destination country's own labour authorities have approved the demand. Montenegro's permit system does not naturally produce such an approval in advance of recruitment; the Montenegrin permit follows a named worker and a completed file, which is the opposite order. Establishing what the mission will accept as satisfying that limb — and doing it before you commit to a timetable — is the single most important preparatory step in this corridor.
The site visit, and how to be ready for it
Take the accommodation limb seriously. The provision refers to the employer's office and labour camp — the place workers will actually live.
If your engagement involves site accommodation, the practical consequence is that housing must be in a defensible state before the attestation, not before arrival. That inverts the usual construction-project sequence, in which accommodation is finished in parallel with mobilisation.
This is also, quietly, the corridor's advantage. A file that survives this scrutiny is a file that will survive a Montenegrin labour inspection, because the standard being applied is not lower.
Documents: Nepal is outside the Apostille Convention
Nepal is not a Contracting Party to the 1961 Hague Apostille Convention. It does not appear in the HCCH status table, which as at 30 June 2026 records 130 Contracting Parties. Montenegro is a party by succession, in force 3 June 2006, but the Convention operates only between parties.
Nepali documents therefore require full consular legalisation, and certified translation into Montenegrin is a separate step on top.
The regional contrast is stark and worth stating, because employers routinely generalise across South Asia. India has been a party since 14 July 2005, Pakistan since 9 March 2023 and Bangladesh since 30 March 2025 — but Nepal and Sri Lanka have not followed. A document strategy imported from an Indian or Bangladeshi file will be wrong here.
There is no social security agreement between Montenegro and Nepal, so contributions are paid where the work is performed with no aggregation of insurance periods.
The Montenegrin half, briefly
The receiving side is ordinary. In short: Article 66(1) of the Zakon o strancima allows work only on a residence-and-work permit or a work registration certificate — an entry route is never a work route — and only the permit bases under Article 40(3) consume the annual quota, set at 28,988 for 2026.
The filing mechanics, the quota, the eight no-permit situations under Article 67(1) and the Article 85 certificate list are in our guide to foreign worker employment in Montenegro and the quota page.
Sequencing, which is unusually front-loaded
- Establish what the Nepali mission requires as evidence of destination-country labour approval. Nothing else can be scheduled until this is known.
- Get accommodation to a defensible standard early, on the assumption it may be inspected.
- Assemble the four documents — demand letter, power of attorney, inter-agency agreement, service contract — and run the authentication chain in the prescribed order.
- Agency permission from the Director General, before recruitment.
- The Montenegrin permit, then the contract-and-insurance registration within 24 hours of issuance, counted from the permit date rather than the arrival date.
What this page does not tell you
It does not tell you which Nepali mission is competent for Montenegro or how it currently applies the visit provision — establish that directly, because it drives the whole timetable. It does not name or vouch for any agency. It does not advise on Nepali law.
RoNa Legal is a registered employment intermediary under activity code 78.10 and a legal adviser. We do not supply, lease or second workers, and we are not an employer of record. We build the Montenegrin file and coordinate with licensed agencies where the structure requires one.
Send us the engagement structure before you approach an agency — in this corridor the sequence question comes before every other question, and it is the one most often answered wrongly. Our services are set out on the services page and a file can be opened through the contact page.
