Hiring Chinese Workers in Montenegro: The Party You Contract With Has to Be Licensed, Funded and Accountable

China routes outbound labour through MOFCOM-licensed enterprises that must post an RMB 3 million reserve fund. What that means for a Montenegrin employer.

Employer guide to work permits in Montenegro

This corridor has a feature no other one in our country set has. On the Chinese side, the entity that sends the worker is not simply a recruiter that introduces a candidate and steps back. It is a licensed enterprise that has posted capital against the risk of the placement going wrong, and that carries obligations to the worker for the duration.

That changes the shape of your counterparty risk — mostly in your favour, provided you are actually dealing with such an enterprise.

Chinese nationals were recorded at 396 workers in Montenegro in 2025, within a foreign workforce of 40,567 from 107 countries. Among the non-European corridors in this set, that makes it one of the more established.

Legal position stated as at 3 September 2026.

The 2012 regulations, and who they bind

The Administrative Regulations on Foreign Labour Service Cooperation were promulgated by the General Office of the State Council on 4 June 2012 and took effect on 1 August 2012. Their stated purpose is to protect workers sent overseas to work for foreign employers, and to develop foreign labour cooperation as a regulated activity.

The regulatory design is a gate on the Chinese side. Outbound placement is conducted through enterprises engaged in overseas labour cooperation that are approved by the Ministry of Commerce (MOFCOM) and hold a labour service cooperation licence. An enterprise without that licence is not permitted to place Chinese workers abroad.

For a Montenegrin employer the consequence is direct: the licence is not a quality badge you may weigh against price. It is the thing that makes the arrangement lawful at the origin.

The reserve fund: RMB 3 million, within five working days

The provision that most distinguishes this corridor is financial.

A licensed enterprise must open a dedicated account with a bank designated by the competent commerce department and deposit not less than RMB 3 million as a reserve fund against risks arising from foreign labour service cooperation. The deposit must be made within five working days of registration with the local Administration for Industry and Commerce.

Read that as a counterparty test. It means a properly licensed Chinese sending enterprise has capital committed against exactly the failure modes that hurt a foreign employer — unpaid wages, abandoned placements, disputes with no solvent respondent. Very few sending-side regimes in this country set put money behind the obligation at all.

It also means the licence is expensive to hold, which is a reason some counterparties will not have one.

What the licensed enterprise owes, and why it lands in your file

Under the regulations the foreign labour service cooperation enterprise must protect the rights of the workers it places and may be held liable in wage disputes. Contract verification, insurance cover and pre-departure orientation are mandatory parts of the process rather than optional services.

This is the practical payoff of the regime, and it is worth being explicit about the asymmetry. In corridors with no sending-side gate, a wage dispute lands entirely on the employer. Here, an intermediary with statutory duties and a funded account sits in the chain. That does not remove your obligations as employer under Montenegrin law — nothing does — but it changes who else is answerable, and it is a reason to structure the arrangement through the licensed enterprise rather than around it.

Documents: China has been an Apostille party since November 2023

China acceded to the 1961 Hague Apostille Convention on 8 March 2023, and the Convention entered into force for China on 7 November 2023. Montenegro is a party by succession, in force 3 June 2006, so the Convention operates between the two.

That means an apostille is sufficient for Chinese public documents — no consular legalisation chain. This is a recent change and it is the single largest improvement to this corridor's timetable in a decade; material written before late 2023 will tell you otherwise.

Two qualifications remain. Certified translation into Montenegrin is a separate step and is not replaced by the apostille. And the apostille certifies the origin of the document, not the truth of its contents — a qualification certificate still has to satisfy whoever is assessing the qualification.

There is no social security agreement between Montenegro and China, so contributions are paid where the work is performed with no aggregation of insurance periods.

The Montenegrin half, briefly

The receiving side is ordinary. In short: Article 66(1) of the Zakon o strancima allows work only on a residence-and-work permit or a work registration certificate — an entry route is never a work route — and only the permit bases under Article 40(3) consume the annual quota, set at 28,988 for 2026.

The filing mechanics, the quota, the eight no-permit situations under Article 67(1) and the Article 85 certificate list are in our guide to foreign worker employment in Montenegro and the quota page.

⚠️ One point specific to this corridor deserves emphasis. Montenegrin law does not permit an arrangement in which a foreign entity supplies workers to work under your direction while remaining their employer. Whatever the Chinese sending enterprise's role in recruitment and welfare, the employment relationship on a Montenegrin permit is between you and the worker. Structure the documents so that this is true in substance, not only on the face of the contract.

Sequencing

  1. Verify the licence and the enterprise's standing with MOFCOM before anything else.
  2. Settle the structure so the employment relationship is yours, with the sending enterprise's role defined as recruitment and welfare rather than employment.
  3. Apostille and translate — much faster than the legalisation chain, but translation still takes time.
  4. The Montenegrin permit, then the contract-and-insurance registration within 24 hours of issuance, counted from the permit date rather than the arrival date.

What this page does not tell you

It does not identify or vouch for any enterprise, and it does not advise on Chinese law — for the licence position, the reserve fund and the enterprise's obligations, take Chinese counsel. It does not price the corridor.

RoNa Legal is a registered employment intermediary under activity code 78.10 and a legal adviser. We do not supply, lease or second workers, and we are not an employer of record. We build the Montenegrin file and coordinate with licensed agencies where the structure requires one.

Send us the engagement structure before contracts are signed — in this corridor the question that decides everything is whether the employment relationship sits where Montenegrin law requires it to sit. Our services are set out on the services page and a file can be opened through the contact page.

Legal basis

Frequently asked questions

Can we recruit a Chinese worker directly, without a licensed enterprise?

Outbound placement from China is conducted through enterprises approved by MOFCOM holding a labour service cooperation licence, under regulations in force since 1 August 2012. The licence is what makes the placement lawful at origin, so it is not a matter of preference or price.

What is the RMB 3 million reserve fund?

A licensed enterprise must deposit not less than RMB 3 million in a dedicated account at a designated bank, within five working days of registration with the local Administration for Industry and Commerce, as a reserve against risks arising from foreign labour service cooperation. In practice it means a properly licensed counterparty has capital committed against the failure modes that would otherwise fall entirely on the employer.

Do Chinese documents still need consular legalisation?

No. China acceded to the 1961 Hague Apostille Convention on 8 March 2023 and it entered into force for China on 7 November 2023, so an apostille is sufficient between China and Montenegro. Certified translation into Montenegrin remains a separate step. Guidance written before late 2023 is out of date on this point.

Can the Chinese enterprise remain the employer while the worker works on our site?

No. On a Montenegrin residence-and-work permit the employment relationship is between the Montenegrin employer and the worker. An arrangement in which a foreign entity supplies workers who work under your direction while it remains their employer is not a route Montenegrin law provides. Define the sending enterprise's role as recruitment and welfare.

Is there a social security agreement between Montenegro and China?

No. Contributions are paid where the work is performed and no insurance periods are aggregated between the two systems.

Does a Chinese worker consume the Montenegrin quota?

If the basis is employment, seasonal employment or posted work under Article 40(3), yes — those run on a permit and draw on the 2026 quota of 28,988. An Article 85 work registration certificate and the eight situations in Article 67(1) do not.

Can you supply Chinese workers to our company?

No. RoNa Legal is a registered intermediary under code 78.10 and a legal adviser, not a labour supplier, leasing agency or employer of record. We build and run the legal file and coordinate with licensed agencies where one is needed.
