Most of what an investor needs to know about Montenegro is stable. The entry rule for Chinese nationals is not. It sits in a provision that carries a date, and the date is 31 October 2026.
That makes this a planning question rather than a reading question, so here is the position as the consolidated text has it today, with the parts that expire marked as such.

What Article 6 actually allows
A Chinese passport is not in Article 1, the ninety-day visa-free list. What exists instead is Article 6, and it is narrow in a way that summaries tend to flatten. Until 31 October 2026, a Chinese national may enter and stay up to thirty days on one of two bases:
- as part of an organised tourist group that enters, stays and leaves Montenegro together, holding confirmation of a paid tour arrangement and proof of onward or return travel; or
- on a valid business passport, with an invitation letter in the form the short-stay visa rules require.
Neither of those is a general business-travel right. A Chinese entrepreneur travelling alone on an ordinary passport does not fit either limb, and never did — this is the part most often misread as "Montenegro is visa-free for China".
The card that does not expire
Article 7 is the quiet one. Its second paragraph gives thirty days to the holder of an APEC Business Travel Card, and China is an APEC economy. In the Government's own English text, a cardholder "may enter, cross the territory and stay in Montenegro for up to 30 days, and at the latest until the expiration of the validity of… that business travel card".
Two things follow. First, the card is a personal entry basis: it does not need a tour group, an invitation letter or a business passport. Second, and this is the planning point, Article 7 carries no date. Articles 1a, 3a and 6 all end on 31 October 2026; Article 7 does not, and the July 2026 amendment that rewrote the dated provisions left it untouched.
The same paragraph also covers a residence permit held in the Schengen zone, Australia, Japan, Canada, New Zealand, Ireland, the United States or the United Kingdom — relevant for Chinese nationals living abroad. The first paragraph covers a valid visa of those same countries, and it says in terms that the visa need not be multiple-entry and need not have been used.

Whatever the basis, Article 34 of the Law on Foreigners still caps short stays at ninety days in any one-hundred-eighty-day period, counted from the first entry.
The 1997 treaty is still the one that applies
Here China stands apart from most of Asia. Montenegro's Ministry of Finance lists a double taxation agreement with China — subject income and capital, published at "Sl. list SRJ" 2/97, applied from 1 January 1998 — inherited from the federal state and never replaced. Japan, South Korea, Singapore, Hong Kong, Taiwan, Malaysia, India, Indonesia, Thailand and Viet Nam have no agreement with Montenegro at all.
The rates the Ministry records for the Chinese agreement: dividends 5 per cent, with no participation threshold attached, interest 10, royalties 10. The absence of a threshold is unusual and worth noticing — several of Montenegro's treaties give the low dividend rate only to a shareholder above a stated percentage, and this one does not.
Two cautions, both of which we apply to ourselves. The Ministry's list records rates and gazette references, not article numbers, and its "application date" column has proved unreliable when cross-checked against the counterpart state's own publication. If a transaction turns on the date or on the precise article, the treaty text and the Chinese side's own record are what decide it, not a spreadsheet. Owning and structuring
Nothing in the entry rules touches ownership. A Chinese national or a Chinese company can own an apartment, a house or a commercial unit in Montenegro; the closed categories are agricultural land and the coastal maritime zone, which is public property. Ownership passes when the cadastre registers it, not when the contract is signed.
Residence is the separate question, and there the numbers apply equally to everyone outside the EU and EFTA. The property route asks for a tax-assessment base of at least EUR 150,000, evidenced by the transfer-tax decision. The company route — a Montenegrin d.o.o. with the owner as executive director — carries a renewal condition of at least EUR 5,000 in taxes and contributions paid in the year. And the thing that should be said plainly in this market: there is no citizenship-by-investment programme in Montenegro. It closed. Naturalisation runs on ten years of lawful residence and release from the existing citizenship.
What to do before 31 October
If the trip is exploratory and the passport is ordinary, the honest answer is that Article 6 is the only unpaid route left this autumn, and it fits a tour group or a business passport, not a solo founder. If you hold an APEC card, that is the cleaner basis and it does not expire with the season. If you hold a valid US, UK or Schengen visa, that works too, on the same thirty days.
If a purchase or a company is already in motion, plan for the possibility that from November the default applies and a visa is needed. The Government closed its own escape hatch in the same July amendment: exemptions by special government act are barred from 31 October 2026, and seasonal exemptions from 1 October 2026. "It will loosen next summer" is not something the text supports.
