Made by the Ministry of Spatial Planning, Urban Development and State Property under Article 27(5) of the Zakon o izgradnji objekata (Building Act), Gazette 19/25, 92/25, 160/25 and 114/26.
The gazette's own entry for this act carries two dates that contradict each other at a glance: "entered into force 12.09.2026" in one field and "date of entry into force 12.03.2027" in another. Anyone about to sign a design contract, take over a half-built shell or budget a permit application is entitled to ask which of the two governs their file. We read Article 98 in the gazette's own typeset pages rather than a summary, and the answer is that both dates are real and they do different jobs.
What Article 98 actually says
The closing article reads: the rulebook "stupa na snagu osmog dana od dana objavljivanja u 'Službenom listu Crne Gore', a primjenjivaće se nakon šest mjeseci od dana stupanja na snagu ovog pravilnika" — it enters into force on the eighth day after publication, and will be applied six months after that entry into force. Published on 4 September 2026, that puts entry into force at 12 September 2026 and the start of application at 12 March 2027. The Minister signed it on 2 September 2026 under file number 06-333/26-7804/5.
The gap is not decorative. Article 97 hangs the repeals on the second date, not the first: "danom početka primjene ovog pravilnika" — on the day application begins — six Montenegrin rulebooks cease to be in force, and two 1965 federal rulebooks on inspecting and maintaining load-bearing steel structures cease to apply. Until 12 March 2027 the old rulebooks remain the operative law and the new one sits on the statute book without displacing them.

What the single rulebook puts in their place
Article 2 sets the reach: new construction, and reconstruction, extension and vertical extension of existing structures; concrete, steel, composite, timber, masonry, geotechnical, aluminium and other structures; and both structural and non-structural elements. Article 1 adds technical documentation, use, maintenance and demolition to the same instrument, so one text now governs the whole life of the structure.
The design basis is the Eurocode suite adopted as Montenegrin standards. Articles 52 and 90 point designers to MEST EN 1990 together with the MEST EN 1991, 1992, 1993, 1994, 1997, 1998 and 1999 series and their national annexes, with the standard list set out in Annex 1, which Article 96 makes an integral part of the rulebook. Article 95 is the provision to read twice: where Annex 1 names an undated Montenegrin standard, the edition that applies is the newest one for which a national annex has been prepared and adopted. A newer European edition without an adopted national annex does not become the applicable standard by itself.
Two provisions reach past the designer to the owner. Article 7(2) fixes the design working life at not less than 50 years unless a standard or another regulation says otherwise. Article 23 then sets an inspection rhythm: the interval between main inspections is to be up to five years for bridges, tunnels and other complex structures, and up to ten years for all other structures, including buildings. Article 22 adds that extraordinary inspections and extraordinary maintenance follow earthquakes, fires, explosions, floods, heavy snowfall, unusually strong wind and comparable events, and follow any significant change to the structure. That is a written trigger a buyer can point at when asking a seller what was done after a given event.
What the text does not say
There is no transitional provision. Chapter XI is three articles long — 96 on the annexes, 97 on the repeals, 98 on the dates — and nothing before it addresses projects caught by the changeover. The text does not say which rulebook governs technical documentation already drawn up but not yet through revizija, nor a permit application filed in February 2027 and decided in April, nor a site started under the old rulebooks and still open in 2028.
Two readings are available and the text supports neither over the other. On one, the old rulebooks apply to everything until 12 March 2027 and the new one takes files from that day forward, which is what Article 97 says on its face. On the other, the operative moment is the date the design was made or the application lodged, which is the ordinary reading of transitional law but is not written here. Whichever the Ministry applies, it is not in this document, and we did not find it stated in the Building Act either — we could not open the consolidated text of that statute on the day of writing, so we are recording that as unverified rather than filling the gap.
Our reading
The six months are the point of the drafting, and they are for the design profession rather than for owners. If you are commissioning a structural design now for a building you expect to permit in 2027, the safer instruction to your designer is the new rulebook and its national annexes, because a design that complies with 130/2026 also satisfies the old requirements in substance, while the reverse is not assured once the repeal bites. If your file is already deep in revizija today, the practical exposure is not the standard itself but the calendar: a review that slips past 12 March 2027 lands in a period where the reviewer's own reference has changed. Ask for the applicable standards to be listed in the design — Article 16(7) requires every dated Montenegrin execution standard to be named in the structural design, so the document has to show its own basis.
For someone buying rather than building, the useful part is Article 23. A ten-year main inspection interval gives a concrete question for due diligence on any completed building, and Article 22 gives a second one for anything on the coast that has been through a storm or a fire. What did not change
Existing buildings are not re-engineered. Article 21(2) states that a structure built before this rulebook enters into force is maintained so that its technical properties are preserved and the requirements set by the building's own design and by the regulations under which it was built are met. Nothing in 130/2026 obliges an owner to bring an older building up to the Eurocode suite. The rules on unpermitted construction are untouched as well — the 14 August 2027 clock under the Legalisation Act runs on its own instrument and is unaffected by this one. Nor does this rulebook alter permit procedure, upotrebna dozvola, contractor licensing or supervision duties, which sit in the Building Act and its own subordinate acts. And the 1965 federal steel rulebooks stay applicable right up to 12 March 2027.
How to verify
The act is number 2254 in Gazette 130/2026 and the full typeset text is on the gazette's own site at sluzbenilist.me/propisi/397832; the issue's contents page is at sluzbenilist.me/registri/397833. The body runs to Article 98 before the annexes begin, so page through to the closing pages and read Article 98 for the two dates and Article 97 for the list of repeals with their gazette numbers. Article 21(2) is the sentence beginning "Građevinska konstrukcija koja je izvedena prije stupanja na snagu ovog pravilnika", and Article 23 gives the five- and ten-year figures.
